1. About GuitarManac
GuitarManac ("we", "our", or "us") is a mobile application for iOS and Android that provides tools, courses, and resources for learning and improving guitar playing. The Service is owned and operated by a private individual based in Norway (the "Provider").
2. Acceptance of Terms
By downloading, installing, or using the GuitarManac mobile app you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the app.
3. Eligibility
You must be at least 13 years of age to create an account and use the app. If you are under 18 you confirm you have your parent or legal guardian's consent to use the Service.
4. Accounts
The app requires creating an account to use its features. Authentication is handled by Clerk. You may sign up with email and password or via Google sign-in.
You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
5. Services and Access
GuitarManac provides both free and premium features. Free features include a selection of courses and lessons, a guitar tuner, chord library, scale explorer, practice logging, and a songbook (limited to 10 songs). Premium access ("GuitarManac Pro") unlocks all courses, all lessons, and unlimited songs.
We may add, change, or remove features at any time without prior notice.
6. Subscriptions and In-App Purchases
Premium access is available through in-app purchases processed by the Apple App Store or Google Play Store. The following plans are offered:
- Monthly subscription: recurring charge billed monthly until cancelled.
- Yearly subscription: recurring charge billed annually until cancelled.
- Lifetime access: one-time payment granting permanent premium access.
Prices are displayed in the app before purchase and may vary by region. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your Apple App Store or Google Play Store account settings.
7. Refunds
In-app purchases are processed by Apple or Google. Refund requests must be directed to Apple (via App Store) or Google (via Google Play Store) in accordance with their respective refund policies. We do not process refunds directly.
8. User Data and Privacy
We collect and process personal data as described in our Privacy Policy. By using the app you acknowledge and agree to our data practices.
9. User Content
Users retain ownership of content they create in the app, including songs, practice logs, and notes. By using the Service you grant GuitarManac a limited license to store and display that content solely to provide and operate the Service for you.
All user content is private to your account and is not visible to other users.
10. Microphone Access
The guitar tuner feature requires access to your device's microphone to detect pitch. Audio is processed entirely on your device using a local pitch detection algorithm. No audio data is recorded, stored, or transmitted to any server.
11. Intellectual Property
All materials, code, assets, courses, lesson content, and other content published by GuitarManac are the intellectual property of the Provider and are protected by copyright. You may not copy, modify, distribute, or publicly display the app's materials without prior written permission.
12. Prohibited Use
- Share or sell your account access to others.
- Copy, redistribute, or republish GuitarManac materials, courses, or code.
- Reverse-engineer, decompile, or disassemble the app.
- Use the Service for any unlawful purpose or to harm the platform or other users.
- Attempt to gain unauthorized access to the app's servers or systems.
13. Termination
We may suspend or terminate accounts for violations of these Terms. Upon termination your right to access the Service ends immediately. Active subscriptions will not be refunded upon termination for cause.
14. Disclaimer and Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. GuitarManac is an educational tool and does not guarantee specific learning outcomes.
To the fullest extent permitted by applicable law, we disclaim all warranties and limit our liability for damages arising from use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
15. Third-Party Services
The app integrates with third-party services including Clerk (authentication), RevenueCat (purchase management), and the Apple App Store / Google Play Store (payment processing). Your use of these services is subject to their respective terms and privacy policies.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Norway. Disputes shall be brought before the Norwegian courts, subject to any mandatory consumer protection provisions that provide otherwise.
17. Changes to the Terms
We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. If we make material changes, we will notify you through the app or via email. Continued use after changes constitutes acceptance of the updated Terms.
